Terms of Service

Agreement

These Terms of Service ("Terms") form a legally binding agreement between you and DayBrief ("DayBrief", "we", "us", or "our"), an SMS‑based daily briefing service operated from Ontario, Canada. By signing up for or using DayBrief, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the service.

Subscription & billing

DayBrief is offered as a $4.99 USD per month subscription with a 7‑day free trial. All payments are processed by Stripe; DayBrief never sees or stores your card details.

SMS messaging

By signing up, you consent to receive SMS messages from DayBrief, including:

Standard carrier message and data rates may apply. International rates may apply outside North America. Reply STOP to any message to opt out — note that opting out effectively pauses the service. Reply HELP for assistance.

Google Calendar

When you connect Google Calendar, you grant DayBrief permission to read your calendar events and, only when you explicitly request it via SMS, create, update, or delete events on your behalf. Our handling of Google data is governed by our Privacy Policy and complies with the Google API Services User Data Policy, including the Limited Use requirements.

You can revoke DayBrief's access to your Google account at any time from myaccount.google.com/permissions. Revoking access does not automatically cancel your DayBrief subscription — cancel separately from your dashboard or by SMS.

AI‑generated content

DayBrief uses Anthropic's Claude AI to generate briefings and respond to your messages. AI output can be inaccurate, incomplete, or out of date. You are responsible for verifying anything important (especially calendar changes, dates, and times) before relying on it. DayBrief is not a substitute for your own judgement.

Service availability

We aim for reliable delivery but cannot guarantee 100% uptime. Briefings or reminders may occasionally be delayed or fail due to factors outside our control — carrier outages, Google API limits, Twilio incidents, Anthropic outages, internet disruptions, or force majeure. We are not liable for missed events caused by service interruption.

Intellectual property

The DayBrief service — including the name, logo, software, design, and text — is owned by us and protected by intellectual property laws. You retain all rights to your own content (your calendar events, the messages you send us). By using the service, you grant us a limited, worldwide, royalty‑free licence to process your content solely as needed to operate the service.

Disclaimers

DayBrief is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, accuracy, and non‑infringement. We do not warrant that the service will be uninterrupted, error‑free, or that defects will be corrected. We are not your assistant in any legal or professional sense.

Limitation of liability

To the maximum extent permitted by law, DayBrief, its operators, and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, business opportunities, or goodwill, arising out of or related to your use of the service. Our total liability for any claim arising from your use of DayBrief is limited to the amount you paid us in the twelve months preceding the claim.

Termination

You can stop using DayBrief at any time by cancelling your subscription and deleting your account. We can suspend or terminate your access if you violate these Terms, if required by law, or if continuing to provide the service to you would be unduly burdensome. Sections that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, governing law) will survive.

Changes to these Terms

We may update these Terms occasionally. Material changes will be communicated by SMS or email at least 14 days before they take effect. Continued use of the service after changes take effect means you accept the revised Terms. The "Last updated" date above always reflects the most recent version.

Governing law

These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict‑of‑laws principles. Any disputes will be resolved in the courts of Ontario, except where applicable law allows you to bring proceedings in your local jurisdiction.
